Help Fight the Nassau County Fire Marshal

Passing this along, even if you don’t have fuel delivered to you this is costing you money. Fuel docks can be few and far between and your at their mercy when it comes to pricing. Home delivery gives you a way to fight it.

Please sign the petition and any help you could offer regarding contacting any politician is greatly appreciated.
We tried hiring a lobbyist, he went to 4 politicians who all said the same thing.
“until they get complaints from numerous constituents they’re not going to fight the Fire Marshal”

First thank you for your help in the past, my family and I appreciate your business and Rising Tide hopes to serve you in the future.
We started this business to provide Long Islanders an easier, safe and more economical way to satisfy their fueling needs for their work vehicles and boats.

With your help again, we can continue to service your needs. A recent ordinance which hurts small businesses was brought about by the Fire Marshal. This will make delivering Gas or Diesel to Motor Vehicles in Nassau County illegal. Most of Suffolk is banning Gas to boats, Diesel could be next. These ordinances cost you money and your time.

You may have received a recent request to sign an online petition. We were hoping to approach the politicians and let them see that this change hurts Long Islanders and their constituents. A lobbyist we hired to fight this issue met with some of our local politicians. All said the same thing – there isn’t enough noise to bother with it. Imagine that – politicians not wanting to save you money.

Media coverage and complaints from constituents is the best and only option for making NOISE to make a change.

You know what we are up against. These are the same media outlets (Newsday, Channel 12, and Channel 7) that carried the story of the Fire Marshal falsely arresting me for this service in 2016. They did not report anything about the falsification of the arrest warrant, the lies during the court process, or the misrepresentation of the purpose of the legislature’s ordinance. Result – full DISMISSAL but of course no media coverage on that.

How can you help make NOISE? Contact your representatives and sign the petition. If you want a choice in the future one email won’t cut it. We have to keep letting them know our money and time is important and they should fix this!

Best ways to get a response - Make it personal. They represent you, so shouldn’t they care about what is best for you? This legislation will permanently cost you time and money. Just this week, one of our customers said he went to a fuel dock and the handle dripped gasoline the entire time he was fueling. That isn’t safe. Include things like that or other problems with fuel docks you have personally experienced.

TANK TRUCK DELIVERY - AN INFORMED CHOICE FOR CONSUMERS
WHY TANK TRUCK DELIVERIES TO BOATS ARE SAFER THAN AT A MARINA:
#61623; Tank Truck deliveries are to a COLD engine. A marina is almost always filling a HOT engine.
#61623; Tank Truck deliveries are scheduled and occur usually when no other individuals are around. At a marina, numerous people are in close proximity - from the occupants in the boat filling up, to unsuspecting occupants in surrounding boats milling nearby.
#61623; Tank Truck drivers are trained for fuel distribution and pass a hazmat examination every 2 years. At a fuel dock, the employee hands the boater the hose to minimize or eliminate the fuel dock's liability regarding fueling the boat if anything should occur.
#61623; Tank Truck deliveries are to a single boat at a predetermined time that is both convenient and safe for all. Fuel docks often become crowded at peak times and have boats constantly driving by during the actual fueling process.
#61623; Tank Truck deliveries allow for sufficient time to deliver and ensure the area is safe. At marinas, the boater is encouraged to leave the fuel dock as soon as possible so they can handle the next customer, not allowing proper time for vapors to dissipate.
#61623; Tank Truck deliveries from a properly licensed source have not resulted in any dock fires. Unfortunately, numerous dock and boat fires have occurred as a result of marina fueling incidents.
#61623; Tank Truck deliveries are contained, scheduled and safer preventing environmental hazards during the actual service or when a truck is securely parked at its facility. During Hurricane Sandy spills from fuel docks caused 1000s of gallons of Gasoline and Diesel to be spilled into our waters and neighborhoods.
#61623; Tank Truck deliveries continue to be an environmentally safer alternative. WHY TANK TRUCK DELIVERIES TO BOATS ARE CHEAPER THAN AT A MARINA:
#61623; Tank Truck deliveries allow the consumer to have a choice. There are fewer and fewer fuel docks available to boaters. Limited competition will drive the pricing up.
#61623; Tank Truck deliveries come to your personal location. Often a boater has to travel 20 minutes to get to a fuel dock, costing their time and money on the commute and will spend upwards of 50 cents or more per gallon at a fuel dock.
WHY TANK TRUCK FUEL DELIVERIES SHOULD BE ALLOWED IN NEW YORK:
#61623; Tank Truck deliveries of Gasoline and Diesel to boats is allowed in at least 6 other states
allowing the consumer a choice.
#61623; New Yorkers had a choice. The push to eliminate your choice was started by owners of fuel docks and those who financially benefit from limiting your options.

TANK TRUCK DELIVERY - AN INFORMED CHOICE FOR CONSUMERS
PERSPECTIVE AND FACTS:
#61623; When Rising Tide Fuel, Inc. was started, 6 different Fire Departments were consulted about this service for their guidance. All agreed with the soundness of the service and provided us with additional professional insight. Current customers include:
- The Amityville, Islip, and Patchogue Fire Departments
- Department of Environmental Conservation
- Bay Constables
#61623; Are you aware that driving around with 1 single gallon of gas in a sealed can that doesn't properly vent the contents the way a car engine does, is equivalent to 12 sticks of dynamite!
#61623; Discontinuing fuel tank delivery service will now necessitate many of our customers filling 5 to 30-gallon containers with gasoline or diesel at a gas station and then drive around town back to their destination. How is that safer for you?
#61623; An argument the Fire Marshal used to change things was that Nassau County is more congested than other areas. The city of Miami actually requests bids to have their Police boats
filled by tank trucks. [As of May 2019, census data lists Miami-Dade County, FL as the largest county in FL with a population of over 2.7 million with a growth rate of 0.82%. Nassau County, NY has an estimated 1.37 million with a growth rate of 0.09%]
CURRENT REQUIREMENTS:
Fuel trucks that deliver to motor vehicles already are regulated by the following requirements and agencies: HazMat Registration, NYS DOT Uniform Carrier Registration, NYS Fuel Bond, NYS Div of Corp, AFC Sticker (plus road tax), Dept of Health/Consumer Affairs Registration, Meter Inspections, Tank Visual Inspection, Tank Vapor Test, Tank Pressure Test, NYS Registration, NYS Motor Vehicle Inspection, Bi Annual HazMat Test, Fingerprint and Background check, 5 insurances policies, and be contracted with an environmental spill company.
NEW REQUIREMENTS/ISSUES:
50’ hose restriction - WHY?
#61623; There is no similar restriction on the reels of marinas, propane deliveries, or home heating oil hoses.
#61623; Marine craft regulation specifically states “It shall be understood that the total length of the hose on
the truck shall be no longer than 50 feet”. NOT that the hose can only extend 50 feet from the truck.
#61623; Construction sites it now states “The dispensing hose shall not be extended from the reel more than
100 feet in length.”
#61623; A fuel company now need 2 trucks, one with a 50’ hose and another with a 100’ hose. WHY?

TANK TRUCK DELIVERY - AN INFORMED CHOICE FOR CONSUMERS
Change Existing Nassau County Fire Code - WHY?
#61623; New York State Fire Code has 2 regulations and the first regulation states, fuel to boats can only be
dispensed from an approved marine fuel dispensing facility and references second regulation. The
second regulation specifically details operations for fuel deliveries to boats from a tank truck.
#61623; NYS Fire Code’s first chapter states, "if there is a conflict between the 2 regulations, the more specific regulation applies. (ie. The regulation with specific detail for dispensing fuel to boats from tank truck
would therefore apply.)
#61623; Nassau County changed their Fire Code to read that if there is a conflict between 2 regulations the
more restrictive regulation applies. This change eliminates the superior instructions of direct distribution and consumer choice. WHY?
Additional delay and expense for Nassau Business Owners - WHY?
#61623; As written, the Fire Marshal could deny almost any delivery location using the following sections of the
changed regulations -
- Each location needs an Engineers Site Plan (cost $550)
- Each location needs to be pre-inspected and approved by the Fire Marshal (cost $550)
#61623; A recent article in a local New Hyde Park paper explains how the Fire Marshal didn’t have the time or manpower to inspect new businesses trying to open. More backlog, more taxpayer expense.
#61623; The Fire Official is allowed to impose arbitrary limits on the times and days during which mobile fueling operations is allowed.
- Mobile fueling shall not take place within 15 feet of buildings, property lines, combustible storage
or storm drains.
- Fuel dispensing shall be prohibited within 25 feet of any ignition source. (In court the fire marshal
described any electrical outlet as an ignition source.)
How many generators, tanks, etc. aren’t within 15’ of a building, property line, storm drain, or 25’ from an electrical outlet??
Regulations are being enforced to Tank Trucks ONLY - WHY?
#61623; Fueling regulations in Nassau are not being enforced in other areas.
#61623; Fleet fueling provides the needed fuel to most of your children's' school buses. As now changed,
School Buses could no longer be fueled this way.
#61623; Charter fishing boats in Freeport obtain their fuel from heating oil trucks in off hours. This would have
to stop.
#61623; The push to stop Tank Truck deliveries was started by some owners of fuel docks. Do we really have to
ask - WHY?
