I notice that the comments are solely on the question of whether their are an adequate number of pumpout facilities in Puget Sound. It sounds to me as if the EPA has already decided to grant the request by WA Dept of Ecology.

The EPA made up their minds the minute WA state asked for it.

Except that the EPA had nothing to do with Washington's ban on copper-based anti fouling paints. :facepalm:

The boatyards and other marine industry types went along with the copper bottom paint ban. Ineffective paint isis good for their business and if there is no copper in paint, they don't have to bother containing it when the scrape and repaint.
 
The "polite" state of Washington simply used extortion to get the yards in line. The threat of lawsuits and of closing businesses forced the yards into compliance.
